Cellnex’s goal, through Omtel, Estruturas de Comunicações, S.A. and ON TOWER Portugal, S.A., is to build and maintain a network of efficient neutral hosting telecom infrastructures that can support wireless equipment and services from mobile operators, so that they can properly cover the area surrounding your land or property. With this goal in mind, we consider that “Trust” is the key element when addressing the relation with landowners of the places where our sites are located. Trust that is built on a relation of transparency and professionalism. We have a long-term vision that favors stability and visibility in the relation with the landowners.

 

We provide secured and controlled access to the site
The arrangements regarding site access follow a standard protocol for cases of regular maintenance or any corrective maintenance needed in our infrastructures. The sites are in general equipped with special locks, remote monitored door alarms, fences and anti-climbing systems where applicable, preventing unauthorized access. In addition, all technical staff is properly trained in health and safety standards.

 

We take full care of our sites
The sites’ infrastructures are regularly maintained and checked for wear and tear, safety, and even theft and vandalism. All the surroundings are kept clean, including deforestation when applicable and needed. In case of any anomaly, you can contact our Network Operating Center at any time 24h/7d. If you detect any situation that could endanger the safety of people, equipment or the environment, please report to us as soon as possible.

 

We have a direct relation with mobile operators
Most of the equipment installed in our sites are from mobile operators, who are our clients. As such, we manage all the infrastructure according to the operators’ needs, with whom we have a direct relationship, and we incur in all associated activities. This way, a relation with us simplifies your life as landlord.

WARNING – If you are contacted by any third party entities regarding the contract you have with us contact us immediately.

Third party entities may try to persuade you to enter into an agreement regarding the lease agreement that you have with us. Such agreements are not authorized under the lease agreement celebrated by OMTEL or ON TOWER with you. Engaging with these third parties may trigger legal disputes and may, ultimately, trigger the site dismantling which, consequently, will end your source of income related to our site.

These third party entities don’t have any relation neither with us nor with the mobile operators, with whom we hold a direct relation and which equipment are installed on our sites.

We are aware that such entities have contacted our landlords in the past claiming to have rights over our lease agreement, which is false.

In addition, bear in mind that OMTEL or ON TOWER are the only companies assure you the full services related with the site, such as security and access control and regular maintenance, and the only company with a contractual relation with the mobile operators, taking full care of any related issues on your behalf.

We provide you below with a quick check list of the documentation or information needed for the most common situations you may be faced with.

1. I acquired a land or a building with an existing OMTEL or ON TOWER contract
• Land Registration Certificate (“Certidão de Registo Predial”)
• Purchase and sale deed
• New owner ID (NIF, address and mobile phone)
• Proof of IBAN, stating the name of the account owner

2. I inherited a land or a building with an existing OMTEL or ON TOWER contract
• Copy of the Habilitation of the Heirs (“Habilitação de Herdeiros”)
• Land Registration Certificate (“Certidão de Registo Predial”)
• New owner ID (NIF, address and mobile phone)
• Proof of IBAN, stating the name of the account owner

3. I want to change my Bank account
• Proof of IBAN, stating the name of the account owner

4. My tax retention framework has changed
As per current tax legislation, if the total income from a natural person’s real estate lease agreements, including your OMTEL or ON TOWER lease agreement and any other lease agreements you might have, is greater than ten thousand euros per year, we are obliged to retain twenty five percent of the amounts that we pay you regarding the lease agreement of our site.

Note that this does not have in principle any financial consequence for you, as all retentions are taken into account by tax authorities while         processing the yearly income tax declaration.

5. Your invoices /rent receipts regarding OMTEL rent payments
In order for a correct acceptance and recording of your rent invoices and/or rent receipts regarding the payments related with your lease agreement with Omtel, please fill them with the following information:

• Tax Number (NIPC/NIF): 515 006 734
All the invoices should be sent by mail addressed to:

Please note that although OMTEL operates under the Cellnex brand in Portugal, your lease agreement has a legal counterparty with the company Omtel, Estruturas de Comunicações, S.A., which is fully owned by Cellnex Telecom, S.A. and is the company that manages all the operational aspects related to your contract.

In addition, please note that the lease agreements regarding our sites in Portugal that were executed before September 3rd, 2018, including with TMN, MEO or PT Comunicações, were transferred on such date to Omtel, Estruturas de Comunicações, S.A., and the above Omtel information should be included in all your financial rent invoices and/or rent receipts.

 

6. Your invoices /rent receipts regarding ON TOWER rent payments
In order for a correct acceptance and recording of your rent invoices and/or rent receipts regarding the payments related with your lease agreement with Omtel, please fill them with the following information:

Please note that although ON TOWER operates under the Cellnex brand in Portugal, your lease agreement has a legal counterparty with the company ON TOWER Portugal, S.A., which is fully owned by Cellnex Telecom, S.A. and is the company that manages all the operational aspects related to your contract.

In addition, please note that the social name of NOS TOWERING – GESTÃO DE TORRES DE TELECOMUNICAÇÕES, S.A. was changed on September 30, 2020 to ON TOWER Portugal, S.A., and the latter should be mentioned in all rent receipts or invoices, as well as the fiscal number (NPIC/NIF) that remains the same.
